Also it didn t start for at least three months. Did I forget to mention that I chose Wisconsin because My dad s family is up there. I was packed and ready to go, careful not to forget anything. My mom had to work today so she would be flying. About seven hours later we arrived! We were in Milwaukee, Wisconsin. And we were at my aunt s house. I walked inside and My Aunt and Uncle were not there because they were at dinner. Another thing I noticed is that there is always this weird smell I notice everytime I come in. I needed a good night sleep so I went right to bed. It was the day of the first game and I was ready. When I got there the park was called the rock. It was amazing I thought with all the crisp fields and nice facilities, I could play a few ball games I said to myself. The fields were so nice they be a major league field. Why is childhood development important to understand when it comes to parenting? Parents have one of the biggest roles in ensuring that their children grow well and in a healthier manner from the time they are born until they become adults. It is very necessary for any parent to ensure that they have ample knowledge about all the parenting roles they need to play. It is necessary that a parent understand the stages involved in childhood development because children need to be handled differently at the various stages. John Muir Free Essays

John Muir, the founder of modern environmentalism, wrote many books on American environmentalism and was vocal in preserving America’s natural landscape. He grew up studying the natural environment and fell in love with its beauty and interconnections. He devoted his life to protecting the landscape from industrialization and the â€Å"Manifest Destiny’ mentality of the late 19th century and early 20th century. Newly available land in the west was also a magnet for Americans eager to farm and tame the land. Muir befriended the likes of Teddy Roosevelt and the railroad executive E. H. Harriman to organize actions that benefitted all parties. Muir’s efforts towards his vision were founding the environmental agency â€Å"The Sierra Club† and writing articles for Century Magazine, hich prompted Congress to create Yosemite National Park. In the article Protecting Yosemite, Muir discusses the challenges and benefits involved in the process of creation and after effects of Yosemite Park. Certain groups strived to benefit economically from the resources of the park, while Muir and others persisted in protecting the parks best interest from the economically driven parties. There was also critiquing and revising the park system throughout the entire process. Muir kept focus on the beauty of the park throughout the article as a whole. As America was creating its new geographical and industrial image westward, most Americans focused on taming the landscape, while John Muir rebelled against this and fought to preserve the natural beauty of America. Protecting Yosemite was written in 1895 and published in The Sierra Club Bulletin in 1896. Muir wrote this to keep the members of the Sierra Club informed on the progress of the Yosemite National Park. The article starts with Muir recounting his previous visit to Yosemite as a disaster because the landscape was â€Å"broken and wasted. (Muir, America Firsthand, PG 97) He follows this observation with a Joyful proclamation that the park has been restored to its original luster, â€Å"Lilies now swing and ring their bells around the margins of the forest meadows. † (Muir, America Firsthand, PG 97) Muir celebrates the Job done by the soldiers who police the land and punish those who commit crimes upon the land. The main Job of the soldiers was to rid the park of Sheppards and their flocks of sheep that would leave the land mangled with hoof prints and erosion. Muir goes on to discuss the great efforts nvolved in getting Congress to pass the Yosemite Bill. Muir sparked the discussion of the bill with the publishing of Century Magazine articles. An unlikely adversary, Mr. Stow of the Southern Pacific R. R. Co. , helped lobby the bill through Congress in 1890. Soon after the creation, an offensive to cut the boundaries of the park in half was launched. The Sierra Club and other environmentally friendly groups halted this offensive. Muir discusses briefly his philosophy and drive for his environmental campaign, † †¦ (someone) should always be glad to find anything so surly good and he park; on one side he applauds the popularity of the park but is disappointed with the effects it has on the park, â€Å"destructive trampling and hacking becomes heavier from season to season. (Muir, America Firsthand, PG 99) Muir is also disappointed with the lack of security, with the exception of the soldiers, â€Å"The Guardian has no power to enforce the rules-has not a single policeman under his orders. † (Muir, America Firsthand, PG 99) Towards the end of the article, Muir believes the management of the park should be transferred to a government department that oesn’t deal with drama related to changing political parties. Final ly, with the prevention of fires in the park, the landscape as a whole becomes more at risk for a devastating fire. Muir believes that forest management should implement a scientific basis to increase the health of Yosemite. America in the mid to late 19th century acted strongly upon the idea of â€Å"manifest destiny. † Two railroads met in Utah and connected the East and West coasts of America. The expanding America was now much easier to populate due to railroads, and land use exploded in the West. Americans started mining and exploiting these newly available resources like iron and timber. Land was taken from Native Americans and they were forced onto smaller and smaller reservations. America bought Alaska from Russia, and acquired The Caribbean and other islands in the Spanish-American-Cuban-Filipino War of 1898. America was very greedy for land at this time and there was the mindset that more is better. John Muir and others rebelled against this idea and raised the argument that more is not better and we should preserve the beautiful landscape that we have. Muir worked very hard to ush this rebuttal onto people and in 1890 he won an environmental battle that created the Yosemite National Park. This set the foundation for modern day environmentalism and helped people come to the realization that we should enjoy nature, and not try to always conquer it. As America was creating its new geographical and industrial image westward, most Americans focused on taming the landscape, while John Muir rebelled against this and fought to preserve the natural beauty of America. Yahweh is salvation Essay The name Isaiah variously translated as salvation is of the Lord, or salvation of Yahweh, and even Yahweh is salvation, unfolds the purpose of the book. The message of the gospel is found throughout the prophecy, and as a matter of fact the prophet concludes with it. As the new heavens and the new earth that I make will endure before me, declares the LORD, so will your name and descendants endure. From one New Moon to another and from one Sabbath to another, all mankind will come and bow down before me, says the LORD, (Isaiah 66:22-23). Salvation is not to be limited to Israel only, for Isaiah as the evangelical prophet speaks also to Gentiles, (Elwell 1989: CDROM). Isaiahs message came at a time when Israel had prosperity, of which produced excessive drinking, idolatry, oppression of the poor, greed and the presence of false prophets who pandered to the desires of the people. Isaiah stressed, (1) salvation by faith (7:9; 28:16; 30:15), (2) the holiness of God and the need for ethical living (6:1-8; 37:23), (3) the offense of human sin and the certainty of divine judgement (chs.1-35), and (4) the assurance of redemption for a repentant remnant (1:9, 19; 10:19-22; 46:3, 4; 65:8-10). The basic theme being contained in Isaiahs name Salvation is of the Lord. The word salvation appears 27 times in the book, (Nelson, 1996:207). Hope for a Righteous King, of the four kings he knew only one consistently served and lived in the ways of the Lord. Hope for atoning saviour, redemption and recovery are the antidote to human brokenness and loss, honest souls need, and most long for, the confidence of an adequate saviour, (Hayford,1995:171). Jesus Christ is portrayed as this saviour. In the first part of the book, Isaiah pictured Israel, in the last part of the book; the prophet beheld Jesus bearing our load of sin, (Mears, 1998:352). Discussion; A distinction between the righteous and the wicked will certainly be made (1:27-31). The future belongs to the remnant, which repents by doing righteousness, but judgment will make an end of rebels and idolaters. The people as a whole are compared to the effects of a drought in which the leaves of an oak fall off and the garden is burned up (v. 30). However, the oak still stands and the garden is still there. Hard times may come upon the godly, but they will persevere. On the other hand, the wicked will be utterly consumed as by fire. (Elwell 1989: CDROM). Structure. The structure of Isaiah has an interesting coincidence. Isaiah is a miniature bible in structure. This book has 66 chapters just like the bible has 66 books. It has two great divisions, with 39 chapters in the first and 27 chapters in the rest, just like the Old and New Testaments. The content also is remarkably similar, eg. The book ends with the vision of the new heavens and the new earth, just as the book of Revelation ends the bible with a similar message, (Mears, 1998:227). As Christians, we are to expect similar resistance in our environment. The prophecies that have come to fulfillment in Isaiah, provides teachings in the power and effectiveness in prophesy in edifying and building the Church. Some of the prophecies that have been fulfilled include; will be born of a virgin (Is. 7:14) was born of a virgin named Mary (Luke 1:26-31) will be spat on and struck (Is. 50:6) was spat on and beaten (Matt 26:67) will be buried in a rich mans tomb (Is. 53:9) was buried in the tomb of Joseph, a rich man from Arimathea (Matt 27:57-60; John 19:38-42) (Nelson, 1996:212). From Genesis to Malachi, one list numbers 124 passages, having 35 of them in Isaiah, each with a specific NT fulfillment. It is a constrictive dispute resolution method to the extent that a decision by such a method cannot be overruled by a public court of law. A public court of law cannot also give awards different from the ones issues by the method. The two most common used methods of alternative dispute resolution are arbitration and mediation. These methods mainly include evaluation of a case that is done on neutral basis, negotiations, conciliation, mediation and finally arbitration. Alternative dispute resolution methods are becoming preferable due to the need to move away from crowded courtrooms, increasing litigation costs, and the delays experienced in courts before judgment is delivered. These reasons have compelled many people across the states to favor alternative arbitration programs. Some of these programs are voluntary while others are mandatory. One of the most informal processes used is mediation. In this form of informal litigation, mediators pair the opposing sides and try to control the process. Mediators are trained personnel who are trained to work out settlements and tries to influence accept or reject decisions. This process is also favored since the parties agree amongst themselves and come up with a resolution unlike a court where a judge is influenced by many factors. Arbitration is mostly used in place of industrial courts to solve matters in industries such as construction and securities regulation.3 The process is gaining popularity and more people are adopting it to solve their disputes. Arbitration agreements are enforceable under federal and state laws. The agreements and awards derive their powers from Title 9 of the U.S. Code. The code bases on Congress plenary power that oversees interstate commerce. Title 9 on itself is more superior to state law. A substantial number of states, approximately forty-one in the United States have adopted the Uniform Arbitration Act. The original version was formed in 1956, while the revised version was done in year 2000. Amendments to Alternative Dispute Resolution Process Every year, many transactions take place in the construction scene. Intermittently, some disagreements arise in the course of this transactions hence the need for arbitration since litigation may cost both parties significantly. This is in addition to the privacy, fairness and promptness of the process.4 When a dispute occurs, the opposing sides may submit their grievances for arbitration. The arbitrators are supposed to be impartial and any conflicts of interest are unethical. According to the American Arbitration Association, the arbitration process has four major rules: the regular track procedures, the procedures for the resolution of disputes through document submission, and the procedures for large complex construction disputes. These rules provide guidelines whenever there is a dispute particularly in the construction sector. The best way to avoid intervention by the courts as much as possible is to employ institutional arbitration, which provides a framework that can establish an arbitral tribunal and activate the process despite any disagreements or problems that arise. Thus, the institution can appoint arbitrators, make decisions on disqualification, see to the smooth operation of the procedure and the meeting of deadlines, set arbitrator compensation (which is a very tricky undertaking when the parties deal directly with the arbitrator without going through an institution) and set parameters for the award, as required and in accordance with pre-established conditions. Initially, the United States Code governed alternative dispute resolution processes. It was amended in 1998 to provide for some features due to the advent of time. The amendments allowed all districts to adopt the provisions of the Act under Section 2071 (a). The amendment also gave powers to neutral evaluation, ministerial, mediation, and arbitration as means of solving civil cases. This was provided under Section 654 to 658 (Clare, 2003). The Act provides for a new statutory payment regime, which introduces a right to interim or periodic payments and a final payment and requires an adequate mechanism in a contract for determining what will become due and when. Default provisions are provided for, which automatically apply in the event that no adequate mechanism is provided in the contract and requires the payee to give a ‘payment claim notice’ to the payer of what is to be paid and how it is calculated not later than five days after the payment date. The payer may not reserve funds unless it has given a rejoinder (akin to a pay-less notification) to the payment request notice, stating the amount it intends to delay from the sum due and the reasons for doing so not later than 21 days after the repayment claim date as stipulated in the contract or the Schedule. Receivers may suspend enforcement when the sum due is not paid by the closing date for payment. Consequently, there is a prohibition on contractual terms that make payment subject upon the payer being reimbursed from a separate source (‘pay when paid clauses’). Persons to whom the Act touches will need to be cognizant of the truth that if the agreement does not provide for a sufficient mechanism for payment when the statutory default payment provisions will apply. One goal of a ‘pay when paid’ clause usually used in the construction business was to exempt the contractor from liability to compensate the subcontractor until the employer had settled it. The outcome of this kind a contractual condition was to enable the contractor to pass the danger of default by the employer to its subcontractors further down the construction chain. The application of these clauses is now forbidden by section 3(5) of the Act. The only exception to this ban is in case that there is a related bankruptcy event in a construction contract. Suspension for Non-Payment Persons not receiving payment in full now have a new statutory right to suspend work under the Act, provided proper notice and particulars are given. The provisions appear to entitle a payee to suspend performance of any or all of its contractual obligations related to the work. There are hopes that the right to suspend will be limited to the actual construction obligations or also, for example, extend to suspension of the right to insure the works or suspension of works in related areas connected with the payment in dispute. Partial payment will not suffice to render suspension unjustified. It will be important to make sure that any seven-day advance notice is clear and served in accordance with the Act’s requirements. Works can be suspended, but only up until such time as where the payment dispute is referred to adjudication or where full payment has been made of the amount due. Much weight will have to be given to the fact that contracts may also need redrafting to allow payees to suspend in accordance with their entitlement under the Act. The Act expressly states that the period of suspension is to be disregarded for the purposes of contractual time limits. To ensure that the contract provisions and time for completion are not thwarted by the operation of the Act, a review of current contractual conditions is strongly advised. For the first time, the Act has introduced a statutory settlement procedure for the settling of payment disputes. Both parties will be permitted to discuss a payment dispute under the agreement to a mediator, whose judgment is required within 28 days (which period may be extended by a further 14 days by agreement between the parties).14 This is not the case in the UK, alternative dispute resolution under this Act will only apply to a payment dispute. The Act does not exactly describe what institutes a payment dispute and it is well known that it is stated in the Act to be â€Å"any dispute relating to payment†. It will be motivating to see how this will function in practice and if guidance is given in the Code of Practice concerning payment disputes once the Code is published. The Act specifies that the arbitrator’s award is obligatory until reversed by another formal process. The opposing parties are required to conform with the decision of the arbitrator, even if they plan to go to court or arbitration proceedings. This will aid in avoiding any deferral to payment. Certainly, the Act provides for a further right to suspend in situations where one party fails to honor (within seven days) any sum due pursuant to the decision of the adjudicator. The target customers of the company’s product are unable to use these imported lamps for the purpose of studying, working and adventurous travelling. So their needs will be satisfied with this product since the proposed product will be designed by using large number of LEDs and a rechargeable battery which is compatible and portable. It is efficient to the extent that, it will provide more hours lighting with the charging time of only few hours and more charging time will increase the usage time. . 2 Key Attributes Company is planning to incorporate two functions in the product using the LED units. That is the unit will have an Active mode and a Bright mode for convenience of the user. Bright mode: This mode is the differentiating feature of the company’s product from other lamps. This is where the unit will be supplied with more power, to the extent that the LEDs will function with its full capacity. So the lamp can be used for studying, cooking or travelling in night purposes. Active mode: This is where the Light emitting diode will be supplied with low power using a small circuit with a help of a switch. This will result in the lamps, emitting light at a lower capacity than its full capacity. This mode can be used to place the lamp in a hall area where you don’t need too much bright. Orbit Star LED Rechargeable Light Orbit Star is a product from Orbit and it uses online selling as a major source of distribution to reach the target customer (www. anything. lk and www. topshop. lk), the accessibility of internet is poor in Central and Northern Province.
